Terms and Conditions for the Purchase of Stallion Semen

These Terms and Conditions govern the purchase of stallion semen (“Product”) from Tipperary’s Finest, hereinafter referred to as the “Seller,” by the buyer, hereinafter referred to as the “Customer.”

1. Contractual Subject Matter

1.1 The Seller sells to the Customer stallion semen as per the specifications specified in the Customer’s order.
1.2 By purchasing the Product, the Customer agrees to these Terms and Conditions and agrees to be bound by them.

2. Ordering and Contract Formation

2.1 The Customer’s order constitutes a binding offer to purchase the Product.
2.2 The contract between the Seller and the Customer is formed when the Seller accepts the Customer’s order and provides the Customer with an order confirmation.

3. Pricing and Payment

3.1 The prices for the Product are as stated on the Seller’s website at the time of the Customer’s order placement.
3.2 A deposit of EUR 350 must be paid upon ordering. There is no entitlement to repayment or partial repayment of the deposit. The deposit entitles the Customer to three attempts of insemination. If none of these result in a pregnancy, the Customer can either choose another stallion or try again with the same stallion in the next breeding season. The Customer is required to send in a vet certificate to the Seller if the mare is not in foal. Any additional costs or fees associated with trying another stallion or waiting until the next breeding season must be discussed with the Seller beforehand.
3.3 Stud fees are payable at 45 days gestation.
3.4 The stud fee is valid for the mare detailed in the order form only and may not be used otherwise.

4. Delivery

4.1 The Seller will deliver the Product to the address specified by the Customer in the order.
4.2 Delivery times are estimates only and the Seller shall not be liable for any delays in delivery.
4.3 The shipping costs and any costs associated with shipping of the Product shall be borne by the Customer.
4.4 The risk of accidental loss or deterioration of the semen shall pass to the Customer when the semen is handed over to the Customer or a person designated by the Customer to take over the semen and, in the case of shipment by a transport company, when the semen is handed over to the transport company.
4.5 If the Product is defective or damaged, the Customer must notify the Seller within 48 hours after receipt in written form and provide photographic evidence where applicable.
4.6 The Seller may engage a third party for the collection, storage, and shipment of the Product. The Customer hereby authorises the Seller to disclose the Customer’s information to such third party for the purpose of fulfilling the contract, and further authorises the third party to directly contact the Customer as necessary.

5. Liability

The Seller shall only be liable in cases of intent and gross negligence. The Seller shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the purchase or use of the Product.

6. Governing Law and Jurisdiction

6.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Liechtenstein.
6.2 Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Liechtenstein.

By completing the purchase of the Product, the Customer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
